(1) A mobile food vendor and a food court for mobile food vendors:

(a) Must comply with all requirements of the state and local health departments and the Department of Labor and Industries;

(b) Are prohibited in residential zones unless approved as part of a special event permit.

(2) A mobile food vendor must:

(a) Conform to the requirements of the International Building Code regarding accessibility;

(b) Not utilize any tents, tarps, or pop-up shelters for food preparation or sales;

(c) Direct any site lighting away from adjacent properties and ensure it is shielded and aimed downward;

(d) Not obstruct pedestrian traffic;

(e) Be parked on a paved or gravel surface;

(f) Not use ADA parking spaces or diagonal parking spaces unless the parking spaces are closed pursuant to a street use permit;

(g) Provide access to a restroom for the vendor’s staff;

(h) Leave the site clean and vacant each day, including picking up all trash and litter within 100 feet of the mobile food vending unit;

(i) Ensure trash receptacles not intended for customer use are screened from public view and securely covered;

(j) Install and maintain an adequate grease trap in the mobile food vending unit and properly dispose of grease per Washington State health regulations;

(k) Dispose of all wastewater generated by the mobile food vending unit in a proper manner and document disposal.

(3) A food court for mobile food vendors must:

(a) Provide seating at the rate of six seats per vendor.

(b) Provide restroom facilities with handwashing facilities either on site or within an adjacent building that is accessible to the mobile vendor food court when the business(es) are in operation. A mobile vendor food court must have at least one restroom. One additional restroom is required for each five vendors in the court.

(c) Direct any site lighting away from adjacent properties and ensure it is shielded and aimed downward.

(4) Generator use must comply with Chapter 7.30 SMC, Noise Control, and may not exceed 70 decibels at 10 feet. (Ord. 1521 § 2 (Exh. A), 2023).
