(1) The hearing examiner has the duty to:

(a) Hold public hearings and render decisions as prescribed by SMC Title 17 Zoning, permit types;

(b) Hear challenges to code interpretations made by the planning director;

(c) Hear cases and appeals related to code enforcement;

(d) Perform other regulatory, enforcement, or quasi-judicial functions as conferred upon the hearing examiner by the mayor or the city council or as required by ordinance.

(2) The hearing examiner has the authority to:

(a) Receive and examine available information;

(b) Conduct public hearings and prepare a record thereof;

(c) Administer oaths and affirmations;

(d) Examine witnesses;

(e) Regulate the course of the hearing;

(f) Make and enter decisions;

(g) Hold, at the hearing examiner’s discretion, conferences for the settlement of simplification of issues;

(h) Dispose of procedural requests or similar matters; and

(i) Take any other action authorized by or necessary to carry out this chapter. (Ord. 1513 § 1 (Exh. A), 2023).
