5.08.020 Applicability.
(1) This chapter applies to merchants without a fixed location, such as door-to-door salespeople, food trucks or other mobile or vehicle-based vending of merchandise, or temporary concessionaires, whether or not a business license is required by Chapter 5.02 SMC.
(2) This chapter does not apply to:
(a) Merchants who operate within the city less than one day per year;
(b) Public officers selling property under authority of law and to persons selling property under court order;
(c) Special events, which are regulated by Chapter 5.06 SMC, but may apply to vendors operating at special events;
(d) Deliveries of meals on wheels and food basket or hot food delivery, by churches or other not-for-profit charitable organizations, to the elderly, sick or physically challenged;
(e) Deliveries of other services or merchandise arranged at a location not otherwise subject to this chapter, including delivery of newspapers and food pursuant to orders taken at an established place of business. (Ord. 1521 § 2 (Exh. A), 2023).
