(1) The definitions in RCW 82.02.090 are incorporated by reference.

(2) As used in this chapter:

“Applicant” means the person applying for a building permit or other permit that requires calculation of an impact fee.

“Building permit” means the permit required for new construction and additions pursuant to SMC Title 14. The term “building permit” as used herein may not be deemed to include permits required for the remodeling, rehabilitation, or other improvement to an existing structure, or rebuilding a damaged or destroyed structure; provided there is no increase in the applicable unit of measure for nonresidential construction or the number of dwelling units for residential construction.

“Capital facilities plan” means the capital facilities element of the Stanwood Comprehensive Plan. Any reference to the capital facilities plan includes the city of Stanwood’s six-year capital improvement program adopted as an amendment to the Comprehensive Plan by the city council.

“Department” means the community development department of the city.

“Director” means the city of Stanwood director of community development.

“Public facilities” means the following capital facilities owned or operated by government entities: (a) public streets, roads, and bicycle and pedestrian facilities that were designed with multimodal commuting as an intended use; (b) publicly owned parks, open space, and recreation facilities; (c) school facilities; and (d) fire protection facilities.

(3) With respect to the school component of the impact fee, the following definitions apply:

“Capacity” means the number of students a school site and its school building are designed to accommodate.

“Capital facilities plan” means the capital facilities plan prepared by or for the school district and adopted by reference into the capital facilities element of the city of Stanwood Comprehensive Plan.

“Development” means all subdivisions, short subdivisions, conditional use permits, or building permits for construction of new residential dwelling units. This definition does not include attached or detached accessory dwelling units or “housing for older persons” as defined in Title 46 U.S.C.

“School district” means the Stanwood-Camano School District No. 401.

“Student factor” means the student generation rate (SGR), i.e., the number of students of each grade span (elementary, middle/junior high, high school) that the school district determines is typically generated by dwelling unit types within the school district. (Ord. 1520 § 1 (Exh. A), 2023).
