(1) RCW 82.02.050 authorizes the city to impose impact fees on development activity as part of the cost of financing the following capital facilities owned or operated by government entities:

(a) Public streets and roads and bicycle and pedestrian facilities that were designed with multimodal commuting as an intended use;

(b) Publicly owned parks, open space, and recreation facilities;

(c) School facilities; and

(d) Fire protection facilities.

(2) This chapter is intended to accomplish the following purposes:

(a) To ensure that adequate facilities are available to serve new growth and development;

(b) To promote orderly growth and development by requiring that new development pay a proportionate share of the cost of new facilities needed to serve growth; and

(c) To ensure that impact fees are imposed through established procedures and criteria so that specific developments do not pay arbitrary fees or duplicate fees for the same impact. (Ord. 1520 § 1 (Exh. A), 2023).
