(1) Any person violating any provision or failing to comply with any of the mandatory requirements of the ordinances of the city may be subject to a civil infraction or a criminal charge. If not otherwise specified in the Stanwood Municipal Code, any violation of the city’s ordinances is punishable as a class 1 civil infraction.

(a) The maximum penalty and the default amount for a class 1 civil infraction shall be $250.00, not including statutory assessments;

(b) The maximum penalty and the default amount for a class 2 civil infraction shall be $125.00, not including statutory assessments;

(c) The maximum penalty and the default amount for a class 3 civil infraction shall be $50.00, not including statutory assessments; and

(d) The maximum penalty and the default amount for a class 4 civil infraction shall be $25.00, not including statutory assessments.

(2) Except where a different punishment is prescribed by the Stanwood Municipal Code, any person convicted of a misdemeanor may be punished by a fine of not more than $1,000 or by imprisonment not to exceed 90 days, or both, except that:

(a) Whenever a lesser maximum penalty is provided under state law for a violation of an analogous provision of state law then such lesser maximum penalty applies;

(b) Whenever a minimum mandatory penalty is provided for violation of an analogous provision of state law then such minimum mandatory penalty applies.

(3) Except where a different punishment is prescribed by the Stanwood Municipal Code, any person convicted of a gross misdemeanor may be punished by a fine of not more than $5,000, or by imprisonment up to 364 days, or both, with the same exceptions as described in subsections (2)(a) and (2)(b) of this section.
